Photography and Videography Licensing Agreement
Photographers Jack Fleming and Jill Fleming regularly make submissions to the Library of Congress and Copyright office and regularly license use of our works.
Terms and conditions for the use and/or purchase of the images displayed on JackandJillPhotovideo.com, Facebook, Youtube and Telegram as well as our other social media platforms to share out work.
The “Photographer” and “Videographer” is defined to include Jack Fleming, Jill Fleming, Guest Photographers/Videographers hired and referred by JackandJillPhotoVideo.com
1. License. Photographer hereby grants to the user/purchaser a non-exclusive, limited license to use for non-commercial uses only unless expressly granted. For any non-profit entity or Veteran organization, Jack Fleming, Jill Fleming, JackandJillPhotoVideo.com be given credit for the photographs and or videos, shorts, or reels. For any for-profit entities including monetized social media, a formal request for use of the images is required and it will be reviewed on a case-by-case basis via our website Contact page or direct email.
2. Ownership of Art, Photos, Videos. Our Photographers and Videographers remain, the sole and exclusive owner of all images, videos, clips, reels or shorts. Except as expressly provided in this Agreement, the Photographer and Videographers reserves all rights and licenses not expressly granted in this Agreement.
3. Restrictions on Use and Usage. The user/purchaser/client will not use the images for any of the following purposes to include but not limited to:
- No Products for Resale. The user/purchaser/client will not use the images on any goods or products for resale or part of a campaign to sell goods or products.
- No Alterations of original digital files in .JPEG, .MOV .HEIF and RAW formats. The user/purchaser/client will not electronically alter the images with the exception of cropping with permission and will be reviewed on a cases by case basis.
- No Sublicenses. The user/purchaser/client will not sublicense any of the images or videos, unless JackandJillPhotoVideo.com is just a referral source and the photographer/videographer will issue their own license once client relationship is established.
- No Unlawful Use or Obscene Use. The user/purchaser/client will not use the Photographs, Videos in any unlawful manner or obscene manner that would cause harm to the business and reputation of Jack Fleming, Jill Fleming or JackandJillPhotoVideo.com.
- No Standalone File Use. User/Purchaser/Client will not use the Photographs, Videos or other digital files in any way that allows a standalone file or content file to be downloaded, extracted, or redistributed by others by legal or illegal methods.
- No Use in Trademark or Logo. The User/Purchaser/Client will not use the Photographs and or Videos/Shorts/Reels in any trademark, design, logo or other marks in efforts to copyright or trademark original works by Jack Fleming, Jill Fleming, and or Photographers/Videographers hired, referred by JackandJillPhotoVideo.com.
4. Indemnity and Hold Harmless. The Licensee indemnifies and holds harmless the photographer against all claims, liability, damages, legal fees, costs, and expenses stemming from a breach of this agreement, the use of the image and or video files, your failure to abide by any restriction regarding the use of an image, or any claim by a third party related to the use of the image.
6. Warranty and Liability. The images, photographs, and or video digital files is provided with no warranty regarding the suitability of the image, video or file for any purpose. The photographer/videographer or referral of JackandJillPhotoVideo.com is not liable to the client or any person or entity for damages, costs, or losses stemming from any use of this image file, video file and or composition.
7. The terms, conditions and limitation of this “Photograph and Videography Licensing Agreement” may be changed, altered, or discontinued at any time by the “Photographer”.
8. Violations of this agreement fall under protections and compensation of the Copyright Act of 1976 and will be prosecuted under the full force of the law.
